Public Invited to Comment on Revised Programmatic Agreement with the Advisory Council on Historic Preservation, Federal Highway Administration, and the South Carolina State Historic Preservation Office

The South Carolina Department of Transportation (SCDOT), in cooperation with the Federal Highway Administration (FHWA) and the United States Army Corps of Engineers, Charleston District (Corps), is accepting comments on a revised Section 106 Programmatic Agreement (PA) with the South Carolina State Historic Preservation Office (SHPO) and the Advisory Council on Historic Preservation.

The PA sets forth the process by which the FHWA, with the assistance of SCDOT, will meet its responsibilities pursuant to Section 106 and Section 110 of the National Historic Preservation Act (54 U.S.C. 306108 and 54 U.S.C. 306101). The agreement authorizes SCDOT initiate and, in most cases, conclude consultation with the SHPO and other consulting parties for purposes of compliance with Section 106 of the NHPA.

Revisions were made to the PA to include the Corps as a signatory and to allow SCDOT to make determinations of eligibility on architectural resources through informal consultation with the SHPO.
